N rest of family lives in Georgia where they have a primary residence …
What is state of residency if we were to transfer into Georgia state school where we Reside

Primary earning member works in another state but only commutes
Tax wil be filed in GA ?

The student state of residence is where the parents RESIDE. If one parent happens to work in a neighboring state, that would not be their state of residence.

When you filed your income tax return, you filed as Georgia residents, right?

And please clarify, are you the student or the parent posting?

The student’s state of residence is almost always where the parents reside. That is because in most states, property takes go to help pay for the state’s public K-12 schools and higher education system.

If the parents are separated or divorced and live in two different states, then sometimes a student can be considered in-state in both of those states.

Working temporarily in a different location does not automatically make someone a resident of that location.

Even if you and your wage-earning spouse were to divorce, and you were entirely dependent on alimony and child support in order to live, provided your child spends more time with you than with the spouse at that other residence, your child would be considered your dependent for in-state residency purposes and financial aid purposes.

@happymomof1 I think it’s state income taxes that support higher education…not property taxes. In states that don’t have an income tax, it’s other taxes that residents pay ongoing.
