Strange FAFSA question..

<p>My mother and I are confused as to what we file for FAFSA. My biological mother is my custodial parent, and was never married to my biological father (she was married to someone else at the time). My biological father is in prison for life (and therefore, I assume he has no income). My mother is re-married, however my step-dad never adopted me and has no legal custody or obligations to me.
My mother says we don't include his income on the FAFSA. However, I am not sure. He doesn't legally have any rights to me.
Can anyone tell me what to do?</p>

The FAFSA looks at the assets of your household, which includes your mother, you, your step-father (because he is married to your mother), and any siblings or step siblings you may have.</p>

<p>Correct. If they are married you by law have to include your stepfather’s income and assets on FAFSA. Adoption or legal obligations are irrelevant.</p>
