Well somebody told me to ask in the parent's forums because they would be better to help me. I was taken into the police station by a police officer for underage drinking. I sat in the station and they called my parents to pick me up. The officer said that he would let me off with a warning and no charges would be pressed, etc. I also remember him saying that this would not go on my record, however im not 100% sure about this. My problem is, on the application of one of my colleges, it asks Have you ever been arrested regardless of the outcome? I dont know how to answer this. I don't really think my incident counts as an official arrest but i dont want to lie by accident and risk it. The general consensus i have recieved from others on the other forums is no because it doesn't really count as an arrest. However some say it could count as an arrest. Any help would be great. Thx

I think that if you had been arrested you would know it. (I've never been arrested, but doesn't it normally involved filing charges or being "booked"?) If you are really in doubt, why not call the police station and ask them? You don't have to identify yourself.

What would i have to say? im nervous lol. silly thing to be nervous about but i would feel awkward calling the station up and asking.

Did they get ID etc from you? Were you issued any kind of citation? If not, my advice (I'm a lawyer) is to NOT put this on your applications. Sounds to me like you lucked out big-time. How did your parents react?

Thx lol. they obviously had my id since they called my parents without asking my number but i think the police just have everybody's number. Im not 100% sure what a citation is but im pretty confident i was not issued one. My parents were upset at first but after a while they forgot about it. Its not like im a bad kid lol i was just stupid that night lol.

A citation would be like a traffic ticket and would have a place where the section of the law that you violated is listed.
I have some experience with these matters..... (and I'm a lawyer)

oh ok then i definitely did not get one of those.

Sounds like you got another chance. Use it wisely.

No need to list it on your college apps, BTW.

And, learn from this . Just this weekend about 40 kids were arrested at a house party at Notre Dame. Kids names were listed in the paper, a big raid occurred at the off campus house, and some bars were targeted. Kids arrested and and cited for
Under age drinking and carrying false identification

So learn from this .... as MOWC stated, consider yourself very lucky

yeh i will. thx for the help
