Do I report this as disciplinary action?

My school has this policy that is 3 tardies=referral. My freshman year I was late to first period 3 times (in a whole semester, which doesn't seem extreme but I don't make the rules!) because my brother, who drove me, had car trouble but my teacher didn't care about that.

I am now a senior and haven't thought about it until I started applying to college...

See at that time in my school the deans didn't care - a teacher would write a student up and send them to the dean's office who would just say don't do it again just go back to class. However we have a portal for checking our grades that also shows are transcripts, absences, basically anything to do with school.

Even though I was never punished for it, that referral is still listed on my referral tab.

When universities ask on applications if I ever received disciplinary action, do I check yes or no? I am unsure and don't want to look like I'm lying in case it's on my record?

No. Disciplinary action is probation, suspension. It is not detention for throwing snowballs or being sent to someone’s office for some tardies.
