<p>This is the first time when I'm filling out fafsa and there's a question about student having lived in state for at least 5 years (I assume this is how they determine whether its your state of legal residency). Well here's my situation: I moved to usa 2 years ago (first i lived in MI with my mum and my stepfather for about a year and I attended a local community college there under a status: legal residency pending (legal residency=greencard), then when I received my green card they let me pay in state tuition status because my stepfather has lived in MI his entire life(and he claimed me on the taxes that year). However, in june/july 2010 we all moved to florida, I got my florida's driver license and lost the one from michigan, i havent been to MI since then and basically lost any ties to this state. My mum is getting a divorce now, her name is on the deed of the house in florida, last year she was unemployed in michigan and worked in florida only, our permanent adress is here in florida. That is why I feel like florida is a state of my legal residence. Neither me nor my mum lived in any other state for more than 5 years.. I am planning on returning to college in fall 2011 and until then i should be a florida resident for tuition purpose (you have to show a presence in florida for at least 12 months). But how is fafsa going to look at this situation? When I check "NO" under a question "Has Student Lived in State for at least 5 years?" does it automatically qualify me as a florida non-resident?

<p>If you select Yes, this state will represent your state of legal residence, which is where you reside and have a true, fixed, and permanent home.</p>
<p>Select No if this is not your state of legal residence or if you have lived in this state for less than 5 years.</p>
<p>If you moved into this state for the sole purpose of attending a school, do not count this state as your state of legal residence.</p>
<p>Obviously I can't check "Yes" but i cant check "No" either. I didn't move here for purpose of attending school - my family relocated here. I wouldn't be even able to prove my ties to michigan after my mum's divorce... Is there's something im missing here? This is so confusing!! Please help :(</p>
