Knittergirrl, the problem is that they only allow smoking (cigarettes) if both roommates are okay with it. I specifically chose NON SMOKING on my application and they were supposed to match me
With someone who also had non smoking. My guess is that the girl didn’t put down that she smokes pot (obviously, because she wanted to get away with it)
If she put down smoking, then it’s the apartment office’s fault for matching us wrong, but I don’t think that’s what happened.
Ah, I see. Still, since what she’s doing is entirely legal (although not allowed inside your apartment), then it should be treated as they would someone who smokes cigarettes.
As a side note, I think as laws and societal norms evolve, colleges will have to start specifying/differentiating those who smoke cigarettes and those who smoke marijuana. Many people I know who smoke marijuana would not want to live with a cigarette smoker, just as I imagine that some people who smoke cigarettes wouldn’t be too pleased about living with a marijuana smoker. I’ll be interested to see if this does happen over the next few years.

If she truly has a medical marijuana card, what exactly is she trying to “get away” with?
I’m not sure why the apartment management is sharing with you the info re: contacting an attorney. I don’t see that as anything you legally need to know. They just should tell you that they’ll get back to you with an answer. You don’t need to be in the midst of the situation resolution.
Almost every apartment in the area has the same policy on marijuana- no smoking it even if you have a card. So she probably knew that going on and didn’t want to call any attention to it so she can smoke pot and if they catch her she can say" You never explicitly said j couldn’t", at least that’s what I’m thinking. I believe they told me about the attorney because they were supposed to call me back days ago and never did, so I called them again to figure out where they were at with the situation or when they would let me know.
I work for an apartment company HQ’d in a legal state. The reason they are contacting an attorney could be due to the question of whether it’s possible to evict someone for smoking a federally illegal substance when the state allows it. Technically they absolutely can, but in some states the judges will not allow it if there is not a blanket no smoking clause in the lease (certainly true in Colorado and other states my company operates in).
Still, I don’t understand why they told you that they were speaking with their attorney regarding this. Seems quite inappropriate.
