Is college board violating federal telemarketer law?

<p>Perhaps someone out there can tell me whether the policy College Board quoted me today is legal. </p>

<p>I got a call form a telemarketer machine for plus loans. The message said your request for a plus loan can't be completed until we get more info, please go to our website, or press 0 to talk to an agent. I pressed 0 as we didn't request a loan and I thought maybe my d checked an interest box putting us on this list. Rep answers, and asks my name to verify she is speaking with correct party. I asked service rep to take me off the list permanently, and she stated that she could, but I would have to give her my husband's date of birth for verification. I then asked to speak to a supervisor about that policy.</p>

<p>The supervisor expalined that a box was checked on the CSS form and that was why they were calling. I said fine, but I want to be permanently removed from the list without having to give you personal information, and she finally agreed (but only when I asked if this was legal).</p>

<p>Is their policy to require my husband's DOB before they will take me off their list in violation of telemarketer law?</p>

<p>It certainly reinforces my negative perception of this company.</p>
