Three students expelled for harassment at California college

These students sound like a real piece of work.

This is awful.

There was discussion about this when it first came to light. I remember reading all about it. I’m glad they were expelled. Note that they are also barred from other California public schools. They are definitely paying a price for their stupidity and mean-mindedness.

I hope SJSU also expels students who are charged with rape and not threaten the victims who speak out like UNC-Chapel Hill.
Not to mention this Missouri school district.
http://www.cnn.com/2011/CRIME/08/18/missouri.school.rape.claim/</a></p>

If you wish to review the incident, here is the police report:
<a href=“Police Report: Read San Jose State University Police account of dorm hate crime allegations – The Mercury News”>Police Report: Read San Jose State University Police account of dorm hate crime allegations – The Mercury News;
(Note: the university police are real police, as a branch of the state police.)

It’s about time! Frankly, I’m surprised it took as long as it did.

They were not actually barred from attending all "other California public schools,” as @Consolation suggested, just schools within the California State University (CSU) system, the mid-tier schools. That still leaves them the community college system, as well as any of the University of California campuses . . . although their admission to the latter seems unlikely.

Looks like the school does not expect them to escape conviction of various charges. The police report at the end recommends prosecution for the following crimes:

PC 245(a)(1) assault with a deadly weapon other than firearm (felony) (Warren, Beaschler, Bomgardner, minor)
PC 236 false imprisonment (misdemeanor) (Warren, Beaschler, minor)
PC 240 attempted assault (misdemeanor) (Warren, Beaschler, minor)
PC 488 petty theft (misdemeanor) (Warren, Beaschler, minor)
PC 182 conspiracy (misdemeanor or felony) (Warren, Beaschler, minor)
PC 422.6(a) interference with constitutional rights and privileges (“hate crime”) (misdemeanor) (Warren, Beaschler, Bomgardner, minor)

(PC = Penal Code, see http://www.leginfo.ca.gov/cgi-bin/calawquery?codesection=pen</a> )

However, the [San Jose Mercury News article](<a href=“San Jose State expels three charged with hate crime – The Mercury News”>San Jose State expels three charged with hate crime – The Mercury News) only refers to “misdemeanor battery and hate crime charges” that they pled not guilty to.

Note that Bomgardner was the only one not expelled, which appears consistent with the police report indicating his lesser involvement.

@dodgersmom Oops, misread. Or maybe it was wishful thinking. I see community college in their futures…do CA CCs have basically open enrollment?

Basically, yes.
