UVA housing release

To all who may respond. I originally posted a request for ideas or help to get out of a self imposed jam. Instead, I received some lecturing and “expertise” from folks that have no idea of what the complete facts are. So I’m changing this request - unless you have a female UVA student looking for housing please refrain from lecturing me further. I see by the number of posts that some of you have a lot of time on your hands and a lot of advice. Good for you. Glad you don’t have to work for a living - thanks again. Finally a real and sincere heartfelt thanks to those that actually tried to help with some sound advice. signing off

My kids did not go to UVA but one of them did have a similar lease predicament… which was solved by ten minutes of social networking (Facebook is for old people, but someone’s parent was on the “Parents of class of whatever” group and forwarded the message to the kid.) Your D could probably invest 15 minutes in 3 or 4 Facebook posts, her instagram, or whatnot, and have an entire dorm’s worth of worthy young women who want to take over her lease.

No lecturing, but this is not a hard problem to solve. In our day we’d have put up a little sign with tear off slips of paper and would have taken a week. Now it’s instantaneous.

Blossom Unfortunately UVA uses Facebook for housing issues but we can try some other online avenues. Thanks for the good advice.

I attended UVA in the dark ages - I was also a member of a sorority. Can she distribute a flyer to sorority houses or send them an email? Most sorority houses are too small to House everyone who wants to live there, and Lambeth is a convenient location to Rugby Road.

College query Great idea. I don’t know if she can send something electronically but she could go over to the sorority office at Newcomb and talk with them. Wahoowah!

I spoke with my daughter there this afternoon and she said she would ask around. Off grounds options are drying up at this point. She just signed a lease this week but it was getting dicey.

Jmk518. Thanks so much. My daughter had a home lease with some others fall through last year and she really had to scramble to find a place. That is how she ended up at Bice. Go Hoos!

@jmk518 if it’s true that UVA does have a list of people needing housing that registered for housing after the cutoff but they will not use that list to fill the spot” then your daughter would have an EXCELLENT defense to any lawsuit.

Virginia has imposed a duty to mitigate damages for leases. See, Laskin Road Associates, L.P. v. Capitol Industries, Inc., 2007 WL 1655336 (E.D.Va.), 6 (E.D.Va.,2007)

A “ duty to mitigate “ means that they cannot collect money from someone who breaks a lease unless they use good faith efforts to try to get someone else in that housing. They could still do things like withhold the transcript etc… but they would be very very unlikely to be able to successfully sue your daughter if there position is that they won’t actively try to fill the spot.

@maya54 it is actually @donthomasino that has the housing issue. I think it was stated earlier somewhere here that a dorm agreement may not be considered a lease - so maybe that is giving the school a stronger person… I’m not an attorney.

Ahh. I see now that it’s @donthomasino. But whether it’s calked a “ lease”or “agreement” doesn’t really matter. Under Virginia law a party claiming damages for any breach of contract has a duty to use ordinary care to mitigate damages resulting from the breach. See,
Fox-Sadler Co., Inc. v. Earl E. Norris Roofing Co., Inc., 229 Va. 106, 111, 327 S.E.2d 95, 98 (Va.,1985)
