In state = yes. Kinesiology has a lower average ACT and GPA than some of the other schools. You are still below the 25th percentile admission average, but keep in mind that OOS students usually have higher stats, so I would definitely apply. It sounds as if your school does not have much grade inflation, and the admissions office should take this into account. Improving the ACT would also help - any chance you could study and improve on the Dec ACT?
I have seen in-state students admitted with 25’s, but some rejected with 29’s. A lot of it depends on the school you attend and your grades. I hope your ACT improved a lot on the Oct test. Good luck!
