Michigan MIP first offense

I am a student at UM in ann arbor. The other night I was given an MIP and taken to the hospital in an ambulance. I don't remember any of this happening but I was told I was stumbling near the road and that is the cop stopped me. I am really worried that I may need a lawyer even though this is my first time offense because I was taken to the hospital. My BAC was never taken and at the hospital they just had me sleep (didn't give me an IV or test my BAC). I only remember drinking two drinks and I don't know whether I should tell this to the judge or just apologize and say it will never happen again. What do you think? Thanks.

Wait you say you didn’t get a breathalyzer but you also say you don’t remember anything…

Also the judge will pretty much know what you say is BS, but if you follow the right advice the first one isn’t the end of the world.

could have been drugged… not that it would matter. Even the slightest amount of alcohol in the body is enough for an MIP when youre underage.

Your in luck. The first offense for an MIP isn’t too bad. You can read about it below, but essentially you can typically get it expunged by taking substance abuse treatment courses and being monitored for a short term.

[Michigan Legislature - Section 436.1703](<a href=“Michigan Legislature - Section 436.1703”>Michigan Legislature - Section 436.1703)

quote For the first violation by a fine of not more than $100.00. A court may order a minor under this subdivision to participate in substance abuse prevention services or substance abuse treatment and rehabilitation services as defined in section 6107 of the public health code, 1978 PA 368, MCL 333.6107, and designated by the administrator of the office of substance abuse services, and may order that minor to perform community service and to undergo substance abuse screening and assessment at his or her own expense as described in subsection (5).

I would suggest talking to a lawyer before you say or do anything.
