Question regarding State of Residency

I am a high school student in the State of New Jersey. However, my parents pay taxes to the State of New York. Thus, am I a resident of New York or New Jersey? I applied to several colleges as resident of New Jersey, but I am unsure if it is legal for me to receive in-state tuitions for public universities in New Jersey. Please Help!

Where do you live? And remember that legal residency can be different than qualifying for in-state tuition, depending on the rules of the state and/or school.

I live in New Jersey since I go to high school in New Jersey. My mother files her taxes to the State of New York since she has an apartment there.

Ok, so you’re a legal resident of New Jersey. If your mother has an apartment that she owns in New York, she’s A) paying property taxes to a New York jurisdiction because of the property she owns there, and/or B) paying New York income tax if she earns rental income from the apartment. It’s highly unlikely that either of these two scenarios would qualify you as someone who is qualified to pay in-state tuition for public colleges in New York.

You live in NJ. It sounds like your mom is employed in NY and that is why she is filing taxes there.

But I’m betting she is filing those taxes as a non-resident…and files her federal taxes either jointly with your dad, or married filing separately,…but with NJ as her place of residence.

Ask her.

But realistically…you live in NJ…so you ARE a NJ resident. You live there…you go,to HS there. And I’m assuming your other parent lives there as well.
